General Terms and Conditions: By entering the In the Bag Promo, each participant agrees to be bound by these Official Rules and the decisions of Whitefeather, which shall be final. Whitefeather reserves the right, in its sole discretion, to modify, suspend, or cancel the In the Bag Promo at any time if the In the Bag Promo is not capable of running as planned, including if a computer virus, bug, or other technical problem corrupts the administration, security, or proper running of the In the Bag Promo.

Whitefeather reserves the right in its sole discretion to disqualify any individual or entity it finds to be attempting to defraud or in any way tamper with the In the Bag Promo.

Release and Limitations of Liability: By participating in the In the Bag Promo, participant agrees to release and hold harmless Whitefeather, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the In the Bag Promo, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any and all claims or causes of action arising out of participation in the In the Bag Promo or receipt or use of the prize, including but not limited to: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, postage-received or sent mail, or email; (ii) telephone, electronic, hardware or software program, network, internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Released Parties that may cause the In the Bag Promo to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the In the Bag Promo, including without limitation, personal injury, death, and property damages, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the In the Bag Promo. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the In the Bag Promo. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Disputes: Except where prohibited, each participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the In the Bag Promo or any prize awarded shall be resolved individually, without resort to any form of action or class action, and exclusively by the appropriate court located in Wayne County, Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Whitefeather in connection with the In the Bag Promo, shall be governed by, and construed in accordance with the laws of United States and the State of Ohio, without giving effect to any choice of law or conflict of law rules. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participants’ actual out-of-pocket expenses and participant further waives all rights to have damages multiplied or increased.
